ClearHubEA is not a carrier and does not itself provide transport services. Where we facilitate a transaction between two parties, each of those parties is a separate controller of the data they hold about the other.
What we collect
Account data. Your first and last name, email address and telephone number. Passwords are stored only as a one-way hash; where two-factor authentication is enabled, the secret is stored encrypted. We record failed sign-in attempts and temporary account locks to protect against unauthorised access.
Organisation data. Your company’s legal and trading name, country of registration, tax identifier, registered contact details and verification status.
Driver data. Where you register drivers, we hold their full name, telephone number, national identity number, driving licence number, the country that issued it and its expiry date. This is identity data about a third party, and you must have a lawful basis for providing it to us.
Documents. Files you upload — operating licences, insurance certificates, vehicle inspection certificates and proof of delivery — together with their file name, type, size, a checksum, and the issue and expiry dates you record. Proof-of-delivery photographs may show a consignee, a signature or premises.
Transaction data. Loads, quotes, awarded trips, invoices, declared payments and payouts, including the rates agreed.
Technical and audit data. When you act on the platform we record who did what, to which record and when, together with your IP address and browser or device identifier. This is what allows a disputed transaction to be explained months later.
Why we use it, and on what basis
To perform our contract with you — operating your account, matching loads to carriers, recording quotes and awards, raising invoices and settling payouts.
To meet legal obligations — verifying that operators, vehicles and drivers are licensed and insured, keeping accounting records, and responding to lawful requests from regulators or authorities.
For our legitimate interests — preventing fraud and unauthorised access, maintaining an auditable record of transactions, and improving the service. We do not use your data for advertising, and we do not sell it or share it for anyone else’s marketing.
Who we share it with
Counterparties on the platform. When you quote on a load, the posting party sees your organisation, the vehicle and driver you have assigned, and your rate. When you award a load, the carrier sees what they will be paid. Commercial terms that belong to one side are not disclosed to the other.
Service providers. We use Amazon Web Services to store uploaded documents, and a cloud hosting provider to run the platform. These providers process data on our instructions only.
Authorities. Where we are required to disclose by law, or to establish or defend a legal claim.
Where your data is held
The platform is hosted outside Kenya, and documents are stored with a cloud provider that may process them outside the countries in which you operate. Where personal data is transferred out of Kenya we rely on the safeguards permitted by the Data Protection Act, 2019, including contractual protections with our providers.
How long we keep it
Account and organisation data is retained while your account is active and for so long afterwards as we are required to keep it.
Transaction and accounting records cannot be deleted on request. Every movement of money on the platform is recorded in a double-entry ledger that is written once and never edited, and every action is written to an audit log for the same reason. Those records are what allow a payment, a payout or a disputed delivery to be explained afterwards, and we retain them for the period required by Kenyan tax and company law. A request to erase your data will be honoured for the data we are free to erase, and we will tell you what we must keep and why.
Your rights
Under the Data Protection Act, 2019 you have the right to be informed how your data is used, to access it, to have inaccurate data corrected, to object to or restrict certain processing, to request deletion where we are not required to retain it, and to receive a copy of data you provided in a portable form.
To exercise any of these rights, write to info@clearhubea.co.ke. We will respond within the period the Act allows. If you are not satisfied, you may complain to the Office of the Data Protection Commissioner of Kenya.
Security
Access to the platform requires an account, and sensitive actions such as releasing a payout additionally require a second factor. Passwords are hashed, two-factor secrets are encrypted, and traffic between your device and the platform is encrypted in transit. What each account may see and do is limited to its role and to its own organisation.
No system is perfectly secure. If a breach affects your personal data we will notify you and the Office of the Data Protection Commissioner as the Act requires.
Our mobile applications
The ClearHubEA mobile applications collect the same data as the web platform. The camera is used only to capture proof of delivery, at the point you choose to take a photograph; photographs are held on your device until they are uploaded to your trip. The applications do not track your location in the background and contain no advertising or analytics software development kits.
Changes to this notice
We will update this page when our processing changes and will revise the date at the top. Where a change materially affects you we will tell you directly.
